DACA Post-Northern District of CA Injunction FAQ

Dear students,
 
     As you know, in early November the University of California, along with other organizations and individuals who have sued the Trump administration over its rescission of the Deferred Action for Childhood Arrivals (DACA) program, asked a federal judge to resume the program while legal motions proceed.
 
     I am pleased to share that the U.S. District Court in San Francisco granted our motion for preliminary relief. This decision directs the U.S. Department of Homeland Security to resume most elements of the DACA program until the courts ultimately resolve questions over the legality of the DACA rescission.      While this is welcome news, the battle is far from over. Unfortunately, even with this decision, fear and uncertainty persist for DACA recipients across California and the nation who want to continue to live, work, learn and contribute to the country they know as home. The order does not require DHS to process new applications for DACA or applications for advance parole. We also anticipate that DHS may appeal the order.
 
     We will provide updates as soon as possible on the procedure for filing renewals in accordance with the court's order. Please refer to the FAQ below for additional details on what this ruling might mean if you are a DACA recipient.
 
     This decision does not negate, nor lessen, the urgent need for permanent protection through a legislative solution. UC will continue to support DACA recipients by challenging the legality of the Trump administration’s rescission of DACA, by advocating for congressional legislation that would allow for permanent protection, and by providing services and aid to our undocumented students. This includes: Continuing to allow California residents who are Dreamers to pay in-state tuition; Maintaining the DREAM loan program for financial aid;
Supporting campus-based student service centers; Providing free immigration legal services to undocumented and immigrant UC students and their immediate family members; and
Directing campus police not to contact, detain, question or arrest individuals based on suspected undocumented status
 
In the coming weeks, we will provide additional updates on our congressional advocacy, legal next steps and our ongoing support for our DACA recipients.
